Terms of Service

The App is an artificial-intelligence tool that generates an approximate, illustrative preview of how a selected product may look within a photograph of a room that a Shopper provides. The Service is offered on an as-available basis and may change, be updated, or be discontinued over time. We may add, modify, or remove features at our discretion.

Previews produced by the App are generated by automated, artificial-intelligence systems and are provided for illustrative and inspirational purposes only. They are not photographs, measurements, or accurate representations of any product, and should not be relied upon as such.

Colour, pattern, orientation, scale, texture, finish, lighting, and other visual characteristics may vary — potentially significantly — from the actual product and from how it would appear once installed. A generated preview is not a promise, warranty, or guarantee about the product, its appearance, its suitability, or the result of any purchase or installation. Before making a purchase or other decision, you should verify details with the Merchant and, where relevant, review physical samples and professional measurements. Any reliance on a generated preview is at your own risk.

You must be able to form a legally binding contract to use the Service. The App is intended for use by Merchants and their adult customers and is not directed to children. You are responsible for maintaining the confidentiality of any credentials associated with your use of the Service and for all activity that occurs under them.

If you are a Merchant, you are responsible for your store, your product listings and imagery, your compliance with Shopify’s terms and applicable law, and for how the App is presented to your Shoppers. You are responsible for ensuring you have the rights to any product images and other materials made available to the Service, and for any consumer-facing disclosures your jurisdiction may require in connection with AI-generated imagery.

To generate a preview, the App processes an image that a Shopper voluntarily uploads (for example, a photo of a room) together with the selected product image. By submitting an image, you represent that you have the right to do so and that the image does not infringe any third party’s rights or contain unlawful, harmful, or objectionable content.

You retain any rights you hold in images you submit. You grant us a limited, non-exclusive licence to process and use those images solely to operate and provide the Service (including generating the requested preview) and as otherwise described in our Privacy Policy. We do not claim ownership of the room photos Shoppers upload.

You agree not to, and not to permit or encourage others to:

• use the Service in violation of any applicable law or third-party right;
• upload content that is unlawful, infringing, deceptive, harmful, hateful, sexually explicit, or that depicts or targets minors;
• attempt to generate misleading imagery, or use previews to make false or unsubstantiated claims about a product;
• interfere with, disrupt, overload, probe, or attempt to gain unauthorised access to the Service or its systems;
• reverse engineer, decompile, scrape, or attempt to derive the underlying components of the Service, except to the extent this restriction is prohibited by law;
• resell, sublicense, or use the Service to build a competing product, or exceed applicable usage limits by automated or other means.

We may suspend or limit access to protect the Service, its users, or third parties.

The Service, including its software, design, and content we provide (excluding your own content), is owned by Panonamic or its licensors and is protected by intellectual-property laws. Except for the rights expressly granted in these Terms, we grant you no rights in the Service. “Panonamic” and our logos are our marks and may not be used without permission.

The Service operates alongside and relies on third-party platforms and providers, including Shopify and third-party artificial-intelligence and infrastructure providers. Your use of those platforms is governed by their own terms, and we are not responsible for third-party services. We may change the providers we use from time to time.

Fees for the App, where applicable, are presented to Merchants at or before the time of purchase and are billed through the applicable billing channel (for example, Shopify billing or another method we make available). Except where required by law or expressly stated, fees are non-refundable. We may change pricing prospectively, with notice where required.

THE SERVICE AND ALL GENERATED PREVIEWS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY GENERATED PREVIEW WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PANONAMIC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

To the extent permitted by law, you agree to indemnify and hold harmless Panonamic from claims, damages, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms or of applicable law.

You may stop using the Service at any time, including by uninstalling the App. We may suspend or terminate access to the Service, in whole or in part, if you breach these Terms, if we reasonably believe it is necessary to protect the Service or others, or as otherwise permitted by law. Provisions that by their nature should survive termination will survive.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms, and any dispute arising out of or relating to them or the Service, are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Nothing in these Terms affects mandatory consumer-protection rights available to you in your place of residence.
